General Policy

It is the desire of Cantrell & Cantrell, PLLC to provide high quality legal representation and legal advice. Determining the proper strategy for your transaction or tax controversy with the IRS requires a high level of sophistication and often a great deal of time and effort. While this is sometimes expensive, we always attempt to tailor our fees to the value provided to our clients. Of course there can never be a guarantee of a particular result in a given case.

Engagement Letters

Similar to most law firms, for projects extending beyond a single office consultation, we require new clients to sign an engagement letter (fee contract) for our mutual benefit. This document specifies the terms of the engagement, what we will endeavor to accomplish, the billing rates currently in effect, and other important matters. For all office consultations, even initial consultations, we charge our standard billing rates.

Hourly Rates and Billable Time

Our standard policy is to base our fees for legal services on the amount of time required to complete each project or case. Hourly billing rates are determined according to comparable rates charged by law firms in Harris County, Texas. Billing rates vary, depending on experience and expertise of the tax attorneys assigned to your case. Billing rates are also subject to change without prior notice. All billable time is charged in minimum increments of 1/4 of an hour. It is generally impossible to estimate the total amount of time required to complete a project or case. Retainers

For new clients with whom we do not already have an established relationship, we generally require an up-front, non-refundable retainer, the amount of which depends on the complexity of the case. On IRS collection cases, a minimum retainer is required. The minimum is calculated as the greater of $5,000 or 3% of the total amount owed to the government. Time spent in excess of the retainer amount will be billed each month.

Terms of Payment

All invoices are due and payable within 30 days. Any invoice unpaid and outstanding in excess of 30 days is subject to a finance charge calculated at a rate of 12% per annum. This charge will be automatically applied to your account. Your engagement letter will specify that you agree to pay this charge. If any invoice remains unpaid for a period of 60 days, we will withdraw from your case and discontinue working on your project. Thereafter, our attorneys will have no further professional responsibility to continue our representation of you.
